These Terms of Use ("Terms") govern your use of myinsuranceweb.com (the "Site"). The Site is owned and operated by MX Leads LLC ("My Insurance Web", "we", "us", "our"). By using the Site or calling a number displayed on it, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.
1. What the Site is
The Site is an advertising and referral service. It provides general information about healthcare and insurance-related services and connects visitors by phone with independent, licensed third-party providers ("Providers"). We do not provide medical care, insurance, or benefits advice, and we are not a party to any agreement between you and a Provider.
2. Not affiliated with Medicare or any government agency
My Insurance Web is a property of MX Leads LLC, a private company. We are not connected with or endorsed by the United States government, the federal Medicare program, the Centers for Medicare & Medicaid Services (CMS), or any state agency. Use of the words "Medicare" or "Medicare Advantage" on the Site refers to the coverage a visitor may already have and does not imply any affiliation.
3. Not medical advice
Content on the Site is for general information only and is not medical advice, diagnosis or treatment. Always consult a qualified healthcare professional about your health. If you are experiencing a medical emergency, call 911.
4. Eligibility, coverage and cost
Statements that a service may be available "at little to no cost to you" describe how many health plans cover the service and are not a promise about your individual plan. Whether you qualify, what is covered, and any cost to you depend entirely on your plan, your location, and the Provider's verification. Services described on the Site are currently offered to eligible residents of Georgia only.
5. Calls and recordings
Phone numbers on the Site connect you to a Provider or its call center, sometimes through a call-tracking platform. Calls may be recorded and monitored for quality, training, verification and billing. By calling, you consent to recording and to being contacted at the number you called from as described in our Privacy Policy. We may receive a fee from the Provider for calls we generate.
6. Acceptable use
You agree not to: use the Site for any unlawful purpose; place calls that are not genuine requests for information or services; use automated tools to access, scrape or overload the Site; interfere with call-tracking or advertising systems; or copy, reproduce or republish Site content without our written permission.
7. Intellectual property
The Site and its design, text, graphics and code are owned by MX Leads LLC or its licensors and are protected by copyright and trademark law. Third-party names, logos and marks appearing on the Site belong to their respective owners and are used for identification only.
8. Third-party services and links
Providers and any linked websites are independent of us. We are not responsible for their services, content, privacy practices, or any agreement you enter into with them. Any dispute about services you receive is between you and the Provider.
9. Disclaimer of warranties
The Site is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not guarantee that the Site will be uninterrupted, error-free or secure, or that you will qualify for any service.
10. Limitation of liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, consequential, special or punitive damages, or for any loss of data, revenue or goodwill, arising out of or related to your use of the Site or any service obtained through it. Our total liability for any claim relating to the Site will not exceed one hundred US dollars ($100).
11. Indemnification
You agree to indemnify and hold us harmless from any claims, losses and expenses, including reasonable legal fees, arising from your breach of these Terms or misuse of the Site.
12. Governing law and disputes
These Terms are governed by the laws of the State of Georgia, without regard to its conflict-of-law rules. Any dispute that cannot be resolved informally will be brought in the state or federal courts located in Georgia, and you consent to their jurisdiction. You agree to bring any claim individually and not as part of a class action.
13. Changes to the Site or Terms
We may change or discontinue the Site, and may update these Terms, at any time. The "Last updated" date shows when the Terms last changed. Continued use after a change means you accept the updated Terms.
